The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.


The Purchasing Department has received the following request for sole source procurement

Sole Source Justification:

Auxiliary Services purchased apartment furniture and mattresses for the new Sunnyside Apartments through a few state-contract PO’s with Southwest Contract between December 2022 through September 2023. The specific furniture pieces are: loft beds, mattresses, chest of drawers, entertainment units, desks, desk chairs, end tables, and sofas.

For aesthetics of the new building, equity among residents, inventory, and maintenance it is very important to match the existing furniture that was very recently purchased for the Sunnyside Apartments. These items were purchased on state contract PA3394 which expired just a few weeks ago on 02/28/24. The state is not signing new PAs for education furniture at the moment because they are re-soliciting their statewide education furniture portfolio. An RFP will not go out until May. We need this furniture to be installed in July 2024, which will require an immediate PO.

Since the transitional costs of replacing the existing furniture would be over 3 times the amount of this PO ($850,000 vs $245,144), it would benefit Sunnyside Apartments to be able to purchase this furniture as a sole source rather than replace the existing new furniture.
