The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

Sole Source Justification:
There are six USHE institutions that have been using Evisions IntelleCheck AP, Intellecheck Payroll, and FormFusion since 2010. Evisions is an Ellucian Banner strategic partner, and Banner is the ERP in use at each institution. This software seamlessly integrates with Banner and is required to produce Banner output for AP, payroll, student refunds, and direct deposits. For compatibility purposes and due to the estimated transitional costs of over $1.5MM, it is unreasonable and cost prohibitive to switch to different software.
This sole source will be valid for 5 years.
