The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

Sole Source Justification:
The University has been using ChargePoint for the last five years through an awarded contract. Equipment was specified for a new construction project that is presently contracted. A change with the specified equipment will require new design engineering and contractor change orders which will cost the University additional funds and more time delays.
The University proposes using ChargePoint as needed for this construction project for compatibility of EV charging stations. Estimated transitional costs of $10,000.00 are considered unreasonable and/or cost prohibitive.
