The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

Sole Source Justification:

To date, University of Utah has invested an estimated $1,220,861 in the development of the Utah Genomic Data Portal, including integration of the Mosaic Platform into that Portal. The UCGD Core seeks to establish a new agreement with Frameshift to continue licensing and development of the Mosaic Platform-based Utah Genomic Data Portal, with provisions for new Mosaic Platform features, as requested by Utah, and provisions for the long-term licensing, support and maintenance of the Mosaic Platform software from Frameshift.

Custom development and integration of an alternative commercial solution similar to the Mosaic Platform by another supplier is estimated to take a minimum of one year, would require an estimated 1.0 FTE Software Developer and 0.5 FTE Project Lead time at approximately $180,000 average total compensation each, plus commercial license and custom development fees as determined by the supplier annually.  Importantly, developing a relationship with another supplier and planning/integrating another solution into the UCGD Core existing infrastructure would delay or jeopardize a number of ongoing University of Utah grants and projects and would render obsolete previous developments/investments in the Utah Genomic Data Portal totaling $1,220,861.
