The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

The Purchasing Department has received the following request for sole source procurement

Sole Source Justification:

We require results that are consistent with past measurements provided by Neubrex. Measurements of seismicity, strain and temperature in real time are crucial for ensuring the safety of people working in the area, mitigating potential damage to the surrounding infrastructure (windmills, geothermal plant, pipelines, transmission lines), and for creating and monitoring reservoir evolution. Neubrex has been contracted by two of the R&D projects to conduct the initial phases of the monitoring. We will require additional monitoring throughout the stimulation period which will last approximately 30 days. During the initial monitoring, Neubrex will be using specialized recording equipment and proprietary computer programs. For consistency with the data being collected and data previously collected by Neubrex, we require Neubrex to remain on site to complete the monitoring. Neubrex must be sole sourced for this work as it is not possible to have another vendor complete the work.

A cost benefit analysis demonstrates that the estimated transitional costs are unreasonable.
