The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

Sole Source Justification:

Ensodata is the only vendor who offers the use of AI in it’s product to enhance the accuracy and efficiency of it’s sleep scoring software. This is based on talking to the vendor’s representatives and reviewing specifications on the respective web sites. Ensodata has proprietary software which is why modifications cannot be made.

Similar capabilities from sleep scoring software were investigated at national and local conferences. Ensodata utilizes AI to learn the scoring methods of the sleep techs who overscore the studies. The AI tool then takes that learning and applies it to the next set of studies that are scored, thus learning what we consider best practice and increasing accuracy of the results. The other competitors only autoscores but does not learn from the feedback of the staff.
