The Utah Procurement Code provides that a procurement may be made without competition when the University determines that there is only one source that can reasonably meet the University’s need for the required supply or service, as described in Utah Code Ann. § 63G-6a-802.

The Purchasing Department has received the following request for sole source procurement

Current date: 20250421

Product and/or Service to be purchased: Liquid Nitrogen Freezers and Set Up

Sole Source Supplier: Pacific Science, LLC

Earliest Proposed Purchase Date: April 23, 2025

Buyer Name: Kayla McMullen

Sole Source Justification:

Describe the existing equipment, technology, software, accessories, replacement parts, or service, hereafter referred to as “equipment”, with which this purchase must be compatible; include original purchase price and date of purchase for the existing equipment: This purchase of Liquid Nitrogen (LN2) Freezers and inventory system is an expansion of the existing cryorepository system to continue storing patient transplant products/cells.  Current cryorepository system includes 13 LN2 Freezers and associated Oxygen monitoring systems and LN2 Bulk Tank .

What are the estimated transitional costs for moving to new equipment? $676,033, this includes the estimated cost for 10 large freezers, 5 small freezers, frames and racking system for inside the freezers, O2 monitoring system, freight and installation including qualification of the new system.

This cost benefit analysis demonstrates that the estimated transitional costs to replace the existing equipment are unreasonable and cost-prohibitive.
